There is no divorce in the Philippines, but when a divorce is validly obtained and initiated abroad by the foreign spouse, the Filipino spouse shall have the capacity to remarry under Philippine law (Article 26, 2nd paragraph, of the Family Code).
Nonetheless, in the case of Republic vs. Manalo, G.R. No. 221029, April 24, 2018, the Supreme Court answered in the affirmative, the issue of whether or not a divorce decree initiated and obtained abroad by a Filipino spouse, be recognized in the Philippines.
Thus, a Filipino can now initiate and obtain a divorce abroad as long as it is allowed therein, and in accordance with the national law of the foreign spouse.
However, the foreign divorce decree must be judicially recognized first, in order for it to be enforced or confirmed in the Philippines.
A valid divorce decree obtained abroad is not automatically recognized in the Philippines. A foreign divorce decree must be proven, just like any fact, in the Philippine jurisdiction. The proper petition must be filed in court. Philippines Courts do not automatically recognize foreign judgment. It must be proven first. Otherwise, it will presume that said judgment is in accordance with Philippine Law, since divorce is not allowed here.
